Confined Spaces rescue and the law

The current WHS Regulation applies in QLD, NSW, ACT, Tas,SA and Northern Territory.                                           

Victoria and Western Australia have agreed to the principals of harmonisation, but due to various reasons have delayed the implementation of the laws.

 Health and Safety Regulation Section 74: Emergency procedures

(1) A person conducting a business or undertaking must—

(a) establish first aid procedures and rescue procedures to be followed in the event of an emergency in a confined space; and

(b) ensure that the procedures are practised as necessary to ensure that they are efficient and effective.

Maximum penalty—60 penalty units.

(2) The person must ensure that first aid and rescue procedures are initiated from outside the confined space as soon as practicable in an emergency.

Maximum penalty—60 penalty units.


Work Health and Safety Regulation Section 65: Entry into confined space must comply with this division  (Part 4.3 Division 3)

A person conducting a business or undertaking must ensure, so far as is reasonably practicable, that a worker does not enter a confined space before this division has been complied with in relation to that space.

Maximum penalty—60 penalty units

Work Health and Safety Regulation Section 65: Schedule 19 - Dictionary


confined space means an enclosed or partially enclosed space

that—

(a) is not designed or intended primarily to be occupied by

a person; and

(b) is, or is designed or intended to be, at normal

atmospheric pressure while any person is in the space;

and

(c) is or is likely to be a risk to health and safety from—

(i) an atmosphere that does not have a safe oxygen

level; or

(ii) contaminants, including airborne gases, vapours

and dusts, that may cause injury from fire or

explosion; or

(iii) harmful concentrations of any airborne

contaminants; or

(iv) engulfment;

but does not include a mine shaft or the workings of a mine.
